Misguided refusing refunds

Good morning   my daughter purchased goods in May and returned them for a refund also in May, she recieved notification this morning advising that she would not be eligible for a refund as they have gone into administration,  how is that fair?

    What do you think should happen? If a business is bankrupt then there isn't enough money for all of the creditors. Your daughter is (presumably) being treated in the same way as all of the other ordinary creditors.

    It's  not "fair", but if the company doesn't have enough money to pay all it's creditors all that they are owed (possibly doesn't have any money at all), then there is no way for your daughter to get her money back.

    Can she ask that her purchase be returned to her so she can sell it on?

    Missguided isn't refusing a refund, Missguided no longer exists as an operating business and administrators are in the process of winding it up.  Your daughter, probably along with thousands of others, is an unsecured creditor.  That means she's at the back of the queue to get any money back.  She may be lucky eventually, but she needs to assume she has lost her money.  Fair?  It's the way the law works, simple as that.

    I am sure the employees who haven't been paid their wages and have lost their jobs etc may be questioning the fairness of life a lot more than someone that has sent goods back.

    How did she pay for it? If it was by card directly with the site (and not via PayPal or BNPL) then she can do a chargeback to recover the funds.

    If that was a requirement, there would be no buyer for the businesses and lots of employees would be made redundant. Whilst it’s not fair that creditors lose their money, it wouldn’t be fair to require buyers to take on liabilities which they weren’t responsible for either (although, even I might be persuaded to make a special exception for Mike Ashley).
