UKPC Curve ball

Hi all,

First post here as i've been reading info unregistered but I need a little advice...

I received a notice to keeper from UKPC and I have been thus far following the advice on the newbies thread ie appealing and requesting a POPLA. However I made the mistake of appealing early due to missing some vital info but anyway  - I have now received a bit of a curve ball! Following the online appeal UKPC have issued a letter asking for the drivers full name and address so that they can make a final decision regarding my appeal. If I do not provide this information then they will need to "make a final decision based on the previous information received, at this stage and a POPLA verification code will be provided. I've used the template asking for photographs of signage etc and none of this is included in the letter.


A little background on the parking charge:

Parking Charge Date: 29/04/2022

Reason for Issue: Overstaying time. Parked for longer than the maximum period permitted. (This was 14 mins)


Appeal submitted 17/5/22

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date. If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.
The driver of the vehicle was attending a board meeting in relation to Women's mental health for a non-profit organisation. See attached snips of bank statements for costa coffee at the retail park.

I have read the BPA code of practise and think the below applies. leaving a 4 min possible grace period for the land owner or management agent (this is a retail park).
13.3 Where a parking location is one where a limited period of
parking is permitted, or where drivers contract to park for
a defined period and pay for that service in advance (Pay
& Display), this would be considered as a parking event
and a Grace Period of at least 10 minutes must be added
to the end of a parking event before you issue a PCN.
Could anyone advise the next steps required, i'm not sure if to log in to continue the appeal and state 'POPLA or cancel' or simply ignore the request for driver data?

    That's not a curve ball at all. It's a bog standard letter begging you to supply the driver's info' to make their job easier, no different to any and every other UKPC case where the driver's identity has not been given.
    Ignore it and await your PoPLA code.

    What happened when you complained to the landowner?

    Get pics of the site and signage. They won't comply with the BPA's CoP, because they never do.

    Ignore the UKPC letter, then after 35 days they will make their (inevitable) decision to reject your appeal and send you your POPLA verification code. Then it's on to the next step, as outlined in the NEWBIES FAQ Announcement, third post.

    I've yet to contact the landowner, that's tonights job. I've been struggling to find contact details. It's a private company via Brentwood council (I find this odd as the retail park is in Yorkshire). Registered owners

    I'm still on the hunt for contact details. One of the directors of said company above is corporate finance manager at Brentwood Borough Council. Should I complain to the council?

    That UKPC sign is among the worst.  There is no reason to put GDPR 'data use' stuff on the bottom half (or indeed anywhere) on a sign inside the car park.  GDPR data use signs should be at the entrance, in larger font (e.g. underneath that P sign) so drivers can decide if they want their data collected that way, or just turn around and go.

    There is only one reason to clutter a so-called 'contractually agreed' t&cs sign like that!  The terms are so high and so small you'd need a stepladder as well as a magnifying glass.

    The 'data use' stuff is even in larger text than the so-called terms and the parking charge warning.  Utterly illegible.
