Euro Car Park parking charge

Morning,
NTK received for parking in a pub car park and having not entered the vehicle registration on the iPad inside the pub. There are no fees to park, no time limits, dined outside and ordered via the app on mobile device, for table service leaving no reason to enter the pub.
Should an appeal be made on these grounds with proof of purchase or appeal due to poor signage / not easy to see, read or understand. (BPA Code of practice 18.3) and No Evidence of Landowner Authority
Many Thanks.

Reading the NEWBIE sticky you will see that Plan A is best an first - complain to the pub and require them to have it cancelled.1

I have tried this and they say it is out of their hands.0

Tell them 'as will my money be in future'! Well they would say that. The pub instructed the parking company to infest the site and then ailed to instruct you, the customer, how to avoid getting a PCN and if that is their stance then neither you nor your friends or family can afford to visit their establishment again if every visit comes with a £100 surcharge! Also ask them for the name of someone who will appear in court (if it gets that far) as a witness.Tea_biscuits said:I have tried this and they say it is out of their hands.1 -
Hi,
I do hope that someone can help? On the 9th of April we parked at M&B The Malt House in Exeter, we paid for parking via a parking app on my wife's phone and went for a walk. Anyway, a few weeks later, we received a letter notifying us that we hadn't paid for parking. When we checked, we'd punched in the wrong vehicle registration number, we were travelling in a different vehicle! So rather than send a letter off to appeal (as we had paid for parking) we went onto Euro Car Parks' website and sent in an appeal.
Now, rather foolishly I missed a response from Euro Car Parks informing me that the appeal had been rejected a few weeks ago (we get so many emails) and so when the letter turned up in the last week advising that we now owe £85.00 I was really gob smacked!
I have again emailed Euro Car Parks attaching the V5 for the other car (not attached during my first appeal). No response at all!
I have also emailed (attaching much evidence to the BPA, British Parking Association) and tonight received a reply, unfortunately they cannot assist individual appeals and can only deal with breaches to the code of conduct. However this was a little help as it reinforces our position:
BPA's response:
I can see that you've mentioned that the vehicle registration number was incorrectly keyed at the payment machine. Our Code of Practice refers to keying errors and gives advice to our operators regarding dealing with such issues. Our Code states that:
Major Keying Errors
Examples of a major keying error could include:
• Motorist entered their spouse’s car registration
• Motorist entered something completely unrelated to their registration
• Motorist made multiple keying errors (beyond one character being entered incorrectly)
• Motorist has only entered a small part of their VRM, for example the first three digits
In these instances we would expect that such errors are dealt with appropriately at the first appeal stage, especially if it can be proven that the motorist has paid for the parking event or that the motorist attempted to enter their VRM or were a legitimate user of the car park (eg a hospital patient or a patron of a restaurant). It is appreciated that in issuing a PCN in these instances, the operator will have incurred charges including but not limited to the DVLA fee and other processing costs therefore we believe that it is reasonable to seek to recover some of these costs by making a modest charge to the motorist of no more than £20 for a 14-day period from when the keying error was identified before reverting to the charge amount at the point of appeal.
I have tried to appeal via POPLA, however now the parking charge notice number is time expired! Everything is stacked against up as the date looms and we have to pay the £85.00 or expect debt collectors or court I imagine.
This situation is so unfair, we can be seen entering the carpark, I'm guessing ANPR will have logged this. I assume that ANPF did not see the car we keyed into the parking app on my wife's phone (as it was parked at home)! I assume that the V5 copy we sent them will back up the keying mistake also...
Everything seems so weighted to the Car park operator..
Can anyone help?
Many thanks
Jon
