FTB - Solicitor Charges

Hi,

Due to a change in my financial circumstances, I am having to pull out of purchase of a house in scotland.

We had an offer accepted on the house thru the solicitor subject to survey. Survey clause was lifted on monday after the survey came bacl, and we were awaiting property sale conditions from the other solicitor.

Missives have not been concluded. Am i right in saying that my solicitor will not charge us a fee because we have backed out? or will he charge us for time he has spent on it? (max 1 week)

Worried, as ive never done this before and dont want to get landed with a huge fee for pulling out so early in the buying process. Solicitor doesn't open till monday but i know i willl worry all weekend about it.

    Have you checked through the paperwork from your solicitor? It may well show a set of charges if the sale doesn't go through. Mine will charge for the time spent on my case in 6 min units.

  • We backed out of a sale in Scotland earlier this year after the surveyor recommended a retention to the mortgage lender, meaning we couldn't afford to buy it. The solicitor charged us for the work already done (one offer plus one revised offer when it went to a closing date plus chasing up the other side regarding a guardianship situation) and the bill was £105.
