Draft Consent Order to set aside CCJ – do I need a cover letter?

    Hi all,

    I received a response from the court asking for more information - a joint statement from the parking company and I.

    We didn’t receive a PCN from the parking company or correspondence about it until a letter from the bailiffs at the end of June. My registered address has not changed at all.

    My wife, a dr, was heavily pregnant at the time and teaching on an NHS training course at a hotel. She parked in the hotel car park and paid for a ticket, and thought she had left in the allocated time. 

    After hearing about the CCJ, I contacted the hotel and they subsequently requested that the parking company sign a draft consent order.

    Shall I send the parking company a draft statement outlining the above and ask them to sign it?

    Any advice hugely appreciated and thank you for your help so far!

    This is a dodgy scenario as the CCBC could refuse that consent order which is why we are not keen to do things this way, generally.

    See what @Johnersh or @bargepole or @henrik777 think you should put together.

    Thanks @Coupon-mad. I just followed the advice in other threads and got straight on to the hotel once I found out about the PCN. I stated my wife was a patron at the time. We received nothing in the post at all until we received the bailiffs’ letter in June. 

    @Johnersh@bargepole,  @henrik777 - any help would be gratefully received!

    Would the following be sufficient, do you think? It looks like I'd need to send this to the parking company for their approval.

    Dear Sir/Madam,

     

    On…    my wife parked at the…   hotel to teach on an NHS training course. My wife, a surgeon who was 10 months pregnant at the time, paid for her parking and left straight after the course finished. 

     

    We received no parking ticket or any correspondence regarding a parking ticket – therefore having no opportunity to respond – until we discovered the CCJ in May this year. This was despite the parking company having our DVLA registered address, which has not changed in 18 years. We then received a bailiffs’ letter on…    June. 

     

    I contacted the hotel explaining we had paid for a ticket while my wife was teaching as a patron of the hotel and they spoke with the parking company. As a result, the parking company and I both signed a draft consent order to request the CCJ be set aside.
