New ATM Scam

Hello, 4 days ago I tried to withdraw money from an ATM. The ATM never returned my card or cash. I soon noticed something strange about the card reader (kind of a ATM Skimmer but without any electronics)  which I removed. I tried to look for something in the money dispenser but it seems normal. I tried to call the bank immediately infront of the ATM, while waiting and after removing the thing from the card reader I noticed that someone else tried to withdraw money successfully. After speaking with my bank and being advised to wait 48 hours before filing a complaint, the bank still shows the debit in my account. I'm ready to open the ATM dispute. What are the chances of winning this dispute? I'm 99% sure the ATM didn't deliver the money to me or someone else (but who knows?) Thanks for any help.

They often have cctv built in these days.

So what exactly happened? You put your card in, did the ATM respond normally, ie ask for your PIN, then ask you what you want to do, withdrawal/check balance etc, then you selected withdrawal, gave an amount, then what happened?

Normally the ATM would return the card, and then deliver the cash. It wouldn't deliver the cash until you've retrieved your card. But you say it didn't return the card, so it shouldn't have tried to deliver the cash.

Did it ever say "please take your card" or "please take your cash"? Is the debit for the same amount as your attempted withdrawal? Is it an actual debit or just pending, if pending it could just be a pre-authorisation.

ATM took my card Branch Call me the next day to return my debit card.  onlibacking show as an actually   debit (not a pending)

I asked about CCTV but I was told by Bracnh that by privacy rules ATM doesn't have camera but I think there is one camera above the keypad.  looks like one at least with an spheric glass thing

If the ATM did not give you the card back. It should have been cancelled on your call to the bank. That is standard policy for cards retained in ATM.

I take it that you were using a ATM that was from your bank?

ATm transactions always show as debiting straight away on debit cards. But they can take upto 48 hours to update if no cash is given/taken.
Branch will do a audit check from balance of cash & tally roll in ATM.

Device whould have been handed into either branch or the police.

What happened to the bit you removed? That would surely be an important bit of evidence.

I gave it to the Branch whem they returned my card. I was told this was the second time in the last few weeks that the same happened on the ATM of that particular branch. But they didn't seem too enthusiastic on properly checking the CCTV or taking the proper steps to prevent this from happening again.
