Ofgem price caps 1-Apr to 30-Sep-22 - why are E.on Next charging us more, is it legal?

First post ever, be gentle with me, please. I'll keep it unemotive, despite feeling polar opposite.
The Ofgem price cap for 1-Apr to 30-Sep-2022 is £0.28per kWh for electricity and £0.07per kWh for gas.
E.On Next are charging us £0.2948per kWh for electricity and £0.0732 per kWh for gas. I have complained.
E.on next have closed the complaint stating they can basically charge what they want, as long as it's not an increase beyond 54% on what we paid before the last increase; 'allegedly' Ofgem's price cap is just 'A Guide'.
Is there any truth E.on Next's response, however deeply buried in Ofgem's stipulations?

Do you live in the south-east of England by any chance? Unit prices vary around the country and the ones you've given look to be correct - see @QrizB's excellent table at https://forums.moneysavingexpert.com/discussion/comment/78957887/#Comment_789578872

The price cap AVERAGE is 28.34p per kWh, but varies from region to region. I assume at 29.48p per kWh, you're in the south east outside London?0

as GingerTim alludes the cap rates actually vary around the UK & by payment method, the 28p/7p is an "average". The suppliers can play around with the balance of standing charges & rates to achieve a set capped total figure (or under) for the "average" user.
