Faulty item, lots of info for this type of thing, but there is a twist in this tale!

Hi all,

Thanks for making this forum available!

My parents waited 20 weeks for a sofa to be made with the materials they chose and delivered from a long standing well renowned company via a reseller.

It has been delivered and the seats on the sofa don't line up, one is further forwards then the other, the zips holding the seats in don't zip up, and sections of the arms only seem to contain leather and no filling!

So, I can see that this falls nicely into Consumer Rights and they can get a refund.  The shop suggested that they sent that one back and they order another at which point they were asked if they could guarantee if it would come back the same and he said that there was no guarantee.

The question is.... and it sounds mad.... but if they do decide to send this one back and take the risk on a new one coming they won't have anything to sit on for 20 weeks.

If they push for a refund instead, they won't have anything to sit on until they choose a new one and order which will be around 10 weeks for a sofa on a good day.

Is there any way that they can make this easier by asking for a stand in while they wait, or claim inconvenience or compensation?  I mean, they aren't spring chickens and they need something comfortable to sit on while they wait.......

I genuinely don't know if there is any answer to this, it doesn't seem like there will be but I thought I would ask as it seems pretty unfair for them to sit on hard dining room chairs for approximately 3 months because the quality of something they trusted in was so bad.

If you don't ask, you don't get, but I honestly don't think there is any magic wand on this one, it's just one of those things I guess, any thoughts or sections of the Consumer Rights act that I have skipped by that can cater for something like this at all.  Any feedback very much appreciated.

    They have no rights to any temporary seating. What were they using beforehand? Is that still available?

    If not, grab something off Freecycle or similar.

    No, your consumer right is to return the item and wait for the replacement/repair to be done, there's no principle that you get compensated for not having the item in the interim.

    Thanks for the super quick response, I thought this would be the case.  Its a good point tho they took the old one away when they had the new one, wonder what happened to it. thank you!

    Go to their local British Heart Foundation and but furniture to use whilst waiting and then donate it back to them when no longer needed.

    or be cheeky and ask to rent it from BHF for the duration.
