I’ve just received a letter from BW legal informing me I owe them for a contravention in February. They have confirmed that the original notices were sent to my old address and DVLA website confirmed my old address. I did update my V5 but had to post it in as I moved to a new build that wasn’t registered on the dvla website. I never received it back with the correct address but hadn’t noticed until now!
I would contest the parking charge as the barrier to the carpark was raised- same as at the time when I dropped my daughter off at the uni campus (where I got the ticket) when she started there in 2021 and it was confirmed to me there was no charge for parents of students, so I assumed when I visited her in February, and the barrier was raised, that no charges also applied. I regret making that assumption but if I had received a notice from Total Parking Solutions I would have accepted my mistake and paid the reduced fee immediately.
Now BW legal are asking for £180!
Any advice would be appreciated- thank you!
Ps- I have already asked the university and they’ve refused to step in and help.

If it's a LBC then follow what the NEWBIES thread 2nd post says about that stage. You should respond to confirm the right address and to talk about the fake added costs (see recent Gladstones threads for what to respond with. Saves us a lot of typing).
£180, is that a typo? It isn't allowed anyway according to the Govt who banned the fake add-ons in February, but it was capped at £70. So normally the BW demand (that no-one pays, of course) is £170.
Read the new DLUHC Statutory Code of Practice, not that it is retrospective (nor even implemented yet) but it will help you understand what's being done to curb the excesses of this rogue industry.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Then just browse for this weeks threads headed up Gladstones or LBC, or both.

Yes, I'm sorry - the amount they are asking for is £120. I believe this is a NTK - first letter I've received from BW Legal for my "contravention" on February 25th!!
I've followed what I think is the right course from the Newbies thread and sent a SAR to Total Parking Solutions and also an email to BW legal about denying the debt and putting my account on hold, although I'm not sure they can do this until I receive a LBC.
Thank you so much for replying again!0 -
A BW letter is not a NTK. You are not at appeal stage and it will progress to a court claim. Perfectly defendable!
Please re-read what I said. You need to read the Gladstones threads because you've so far only done the basic reply and not the more recent robust one that I advised you to do some digging for.
Also you haven't yet rectified your old address and insisted it is ERASED by TPS and BW? You are missing the latest advice if you've not yet read the other recent threads I suggested (not just the NEWBIES thread). However, if the letter wasn't a LBC yet you can do the more robust stuff in your next response to the LBC.
£120. Are you sure?
