David Lloyd won’t refund my money

Hi all, I was wondering if anyone would know where I stand on the following.

A few weeks ago my wife and I went into David Lloyd to see about joining. We paid the joining fee and the pro rata membership fee for the rest of the month. We realised after a few days we had made a mistake and couldn’t really afford it. We wrote back to them within the 14 day cooling off period to cancel and this is where the issue is. 

They have refused to refund the money due because about 8 years ago we cancelled our membership with them halfway through the contract and they passed the debt to a collection agency. We have been paying it off monthly but the head office of David Lloyd have told us that because there is an outstanding debt on a previous membership they are keeping the money to set off against this sum. Can they do this when we have a payment plan in place with the collection agency?

    TBH I'm surprised as a debtor/previous defaulter that they let you join again

    Does the joining fee they're keeping cover the outstanding debt ?

    Seems more than fair to me.

    You owe them money and have paid them some towards this debt. 


    Should've = Should HAVE (not 'of')

    I realise the OP is unlikely to return to the thread but I am interested in what they and their OH re joined an organisation that they currently have a debt with. They are paying off an existing debt yet signed up for what was probably an additional expensive extra monthly outgoing . If they have a voluntary agreement to repay that debt in instalments I would have thought steering clear of giving any access to additional monies would have been sensible.

    Wonder as 8 years had passed, they had forgotten all about it, or thought the 6 year statute of limitations would cover it. But clearly the DL system still had the details.

    Yes, know the debt can still be paid long after the 6 years & is not simply wiped off👍

    That does make sense, except that OP suggests that they are still paying off that debt and it hasn’t been dormant for 6 years.
