What is my wife entitled to.

Hello everyone.
My wife suffers with fibromyalgia and other health issues.
My income is £26000pa and that's all the income in our home.
I told my wife last year to pack her job in because it was a heavy lifting job.
Because of her illness we applied for pip or (personal independent payment).
This was just on 12mths now and we have been rejected twice.
We are in the process of a tribunal with the dwp.
My big question is what else is my wife entitled to as we can't claim income support because of my income.
If we don't win our claim for pip is there anything we can claim to help our financial income.

    If she has a full NI record for 2019-20 and 2020-21 she could apply for new style ESA.

    This is not means tested and is completely separate to PIP. It can be claimed as PIP. 

    Do you rent your home and/or do you have children? Is your £26,000 your gross income?

  • My income is£26000 gross yes and no children.
    Our home is rented under housings association.
    My wife has worked for the last 15 years in the same job untill last year so NI record is very possible.

    Unless you are excluded by savings over £16,000 you are likely to be eligible for some UC if your wife can qualify for the LCWRA element after having a Work Capability Assessment. Use a benefits calculator to check amounts. It will include a standard amount plus help with rent and from the fourth month could include the LCWRA element. That will give you a maximum amount. There will then be a deduction of 55% of your earnings over £344/month (the disregard will only apply if found to not be capable of work).

    Any ESA will be deducted from the UC but if she’s eligible it is sensible to claim it. If the UC will be less than the ESA just claim the ESA.

    Just to add if you did qualify for Universal credit and your wife wins her PIP appeal then you could also claim the carers element of Uc as long as you care for her for 35 hours a week.
