I've recently purchased a VAX carpet cleaner via Amazon which on first use was leaking water from the seams of the clean water tank. Having worked for a company making similar equipment in the past looks like a manufacturing defect. When I contacted VAX customer services the told me the seller I purchased it through was not and authorised reseller and as such it wasn't there problem and the wouldn't help. I was under the impression that as the manufacturer they were legally obliged to take at least some responsibility for a brand new product if it is defective?
So my question is, legally can VAX say its not there issue and refuse to help of is it a case of tough luck to me and I have to try and get some recourse from the seller (who currently seem to be ignoring my messages)

There is no legal right of warranty. A warranty is provided (if it is provided) on the terms and conditions of the giver of said warranty. Their rules.
You have consumer rights against the seller - depending on when you purchased will depend on what happens next. How recent is 'recently'.0 -
Your rights lie with the seller.
It sounds as if the terms of the warranty exclude unofficial re-selling, which VAX are perfectly able to have as a term.0 -

personally I never buy from Amazon marketplace - too much the wild west for me.1 -
Is the seller a reputable company, or just some guy selling stuff on Amazon?0

The manufacturer (or importer) is only legally liable if their product injures someone. Otherwise, you have no contract with the manufacturer, and so they have no obligation to do anything for you.
If it sticks, force it.
If it breaks, well it wasn't working right anyway.0
