    Just playing devils advocate here but you have to remember the OP would also be seen as a serial complainer, Once or twice in the past will be logged on the system and the T&C's will then be used against them.

    Once or twice over probably a hundred nights over several years. Yout think that makes a serial complainer? As I said one of these occasions I wasn't even going to mention it but the person at checkout asked and then said they would refund with no prompting from me.

    Yes, once you are on the system their attitude changes.

    What was once a goodwill gesture now gets the full T&C thrown at them.

    I never said you were a serial complainer, just that they see you as one and now want to wiggle out of it. Which is exactly what they have done.

    Took them to the small claims court and when premier inn was sent a CCJ they decided to refund me and to pay the court costs.

    Translated as ... OP raised a county court claim (MCOL?) and when PI received the claim form they decided to pay so as to minimise cost risk. They took the pragmatic approach.

    There was no County Court Judgment (CCJ) as there was no court hearing, as if there had been then it is more likely than not that PI would have a good defence per their T&Cs.

    Have you tried booking any further stays with PI? (Don't be surprised if they now decline any further business with you).

    That's a bit quick, do you mean they settled once they got the notification you'd filed to start the process?

    PI didn't respond within the allocated time so I was able to request the CCJ. When I did that PI decided to settle by refunding and sending me court costs.
    Coincidentally we booked another PI last night.
