SABA Penalty Notice By Post
The Notice states that a penalty fine of £100 is due because of the offence 'failing to obtain a ticket or voucher'. The offer to pay £60 is also stated for payment within 14 days of the notice.
Entry and Exit details are stated and an ANPR photograph is shown of the vehicle on ipaymypcn website.
The Driver has thoroughly Read the Newbie post and followed the SABA links on the page and read the posts regarding the SABA Railway Bylaws and that an offence has been committed by breaching Byelaw 14.
The signage at the site is very poor and the Driver wasn't clear that a payment would be required. The payment times were not clearly stated and certainly not clear enough to be seen on entry to the car park.
The Driver didn't 'park' and leave the vehicle either just admiring the Panoramic View from the top of the car park.
I have sent an online Appeal Response Via the ipaymypcn webpage using the templates kindly supplied by you chaps, for which the Driver is very grateful.
I have had an Email response from ZZPS (not Saba) recently and shown below.
I assume the Driver will just need to ignore this letter? It states that they will not pursue or take action against the driver but the owner of the vehicle is liable for all penalty notices issued.
Does the Owner need to appeal again? It asks to either submit an appeal or make a payment within 28 days.
Or
Just ignore the letter going forward over the next 6 Months until it goes away. The owner would only ever reply via email if at all necessary.

PCN Admin Centre acts on behalf of our client, Saba Park Services UK Limited to deal with appeals or payments for the Penalty Notices issued.
This matter relates to a Penalty Notice issued under Railway Byelaws. An offence was committed by breaching Railway Byelaw 14 and therefore a Penalty Notice was issued against this vehicle.
The owner of the vehicle is held liable for all Penalty Notices issued on Railway assets in all circumstances, as such we have no cause of action against the driver or hirer of the vehicle.
All photographic evidence can be found online at ipaymypcn, the site is operated by ANPR camera and any payment for parking registers the vehicle registration.
Our client's signage is fully audited and approved by the British Parking Association.
Please either submit an appeal or make payment within 28 days from the date on the Penalty Notice sent by post.

I was surprised to get a reply asking to either submit an appeal or make a payment.
Happy to submit another appeal identical to the first one, although they don't appear to be chasing Driver?

Happy to submit another appeal identical to the first one, although they don't appear to be chasing Driver?As part of the strategy for dragging this out to the 6-month point, I'd leave this for a few days (you'll need to judge how many), then by second class mail, I would write asking them for clarification on what you've already written, and how it doesn't constitute an appeal.If/when they clarify ask how you should submit whatever it is they now require - after a few days, then again, second class mail. Use this strategy for as long as you can, drag out and count down the weeks/months!

Thanks for the additional advice. Email response from ZZPS customer services was sent around the 10th May. I'm happy to send 2nd class letter through the post, although on the newbie advice it says to use email if poss to help keep a record. However im more than happy to use post to long things out and take your advice and experience.

The only thing I have sent them is the standard 'one size fits all' appeal via online appeals page.

Post is fine provided you keep a copy of what you send and use second class post with a certificate of posting. Keep the certificate safe and clip it to the letter. Do not send the appeal wording again; what you are asking is why the appeal that you have already sent and to which they replied "to either submit an appeal or make a payment" does not constitute an appeal.2

Express your confusion, and could they explain further what they are expecting by way of an appeal. You're going to need to keep thinking about how to stretch each opportunity to engage them .... and get the clock counting down.Stock Letter sent as advised on Newbie info.

Maybe send them an email saying "I am not sure that you are receiving emails, so I have been forced to send my reply by post ". If they do get the email, they will probably wait then for the letter.
