    Hi, thanks so much for your replies. 
    I've already accepted the final decision and sent it back. I was not aware the strr would still stand although it was in for the same fault.
    Can  i have the ombudsman reassess their decision if I put the above forward to the or do I just take a hit and get rid off the car asap.
    So confused and fed up with all this.

    Is the FOS decision actually from an Ombudsman? Often the initial decisions are by a case worker but they get escalated to an ombudsman if either party rejects the initial finding.

    I doubt anyone can give you advice that you can hang your hat on - nobody here can offer formal legal advice (against the forum rules I believe) - that's why I asked earlier about legal cover via insurance/union.

    Yes the FOS decision is final decision from an ombudsman as BMWFS was offering a lot less refund to the caseworker. So I rejected the initial findings and the Final decision is almost more or less the same as the caseworker decision. 
    I will get in touch with the legal team for my car insurance tomorrow and see what they suggest as I really just want to give the car back now and terminate all agreements with BMWFS. For the large company they are  I found there service standards appalling.

    Hi all, many thanks for your help know this one. I sought legal advice from my insurance company and they can't represent for these claims but can advise they advised that it would be a really long process and the costs would Start £5k though can be recovered and I would not be promised any compensation for inconvenience either. 

    I've took my losses and accepted the ombudsman decision and they have put it forward to BMWFS. I chased them today and they said they would arrange collection of the car, I have also requested they cancel my next payment which is due in 3 weeks and they have not responded. 

    Can they still.take the next payment if the car is returned before then? 

    I'm just scared after reading their horrendous reviews. 

    What's the quickest way to get this done with as I need to buy a new car fairly soon. Bu need my deposit back first.
