Energy Miss Selling
i was miss sold my energy contract last September by Scottish Power - they advised my monthly amount on my actual last 12months usage, and then on the paperwork advised estimated monthly cost based on last 12 months usage then in January I received my first bill and my monthly dd had gone from £105 to £236 - i looked into this and on the original paperwork Scottish power had more than halved my annual usage which was how they got the original DD figure of £105. Yet on my first bill they have more than doubled my last 12 months usage - now to me and from everything i have read on line this is clearly a case of miss selling - so i raised a case to the Ombudsman who advised me they have found in Scottish Powers favour -
I recognise the importance you have placed on the usage used by the representative that you spoke to compared to the actual consumption with Scottish Power and therefore, the charges and monthly payment needed to cover these charges. I can see that in the original decision the Investigation Officer explained that due to future usage not being known at the time of agreeing to transfer supply,
but if this is the case then why are Scottish power allowed to state based on your last 12months usage - if this isn't correct - they should have advised me to check the original quote against my usage!!
please can anyone offer any advise as to if there is anything else can do

You should always base any new contract on your knowledge of how many kWh you use each year.
It should never be decided upon a monthly amount but price per kWh plus standing charges and your know usage.
However no issue you raising a complaint with them believing you were misled and see how you get on.0 -
The OP suggests that EOS has already ruled. If it is a Final Decision then the only options available to the OP are accept or reject. I am not sure that anybody has been misled: there is nothing in any energy contract about total annual cost or DD amounts. The total cost calculation is based on an assumed annual usage amount but it is not binding on the supplier or the consumer.
That said, suppliers are required to estimate annual usage based on actual meter readings. If these are not provided then it can estimate.

There is no complaint left. If the ombudsman has already decided against you, you now need to take them to court.
This is the problem with quoting a direct debit amount. Unfortunately the suppliers are forced to do so.
The relevant part of the contract is what you are paying per unit and in standing charges, your usage might be completely different the next year.
What is the damage from the wrong estimated use they based their debit order on? Was there another supplier with cheaper unit rates that you did not commit to because you believe Scottish Power to be cheaper due to their wrong debit order amount?
Were you a customer of Scottish Power before and did you expect them to know your use? I just did a quote on their web site and the direct debit order amount and description looked like they were using real usage, once I clicked into details it was clearly saying they used an estimate that had nothing to do with my annual use, but I am not a Scottish Power customer, so they don't have real data for me.
