Replacing under warranty and including matching accessories

Hello.

I have purchased a pushchair with matching footmuff a while ago in a matching colour. It is the Recaro Celona pushchair and Lite cot/footmuff in pacific blue. There is a 2 year warranty on it and It has failed. The shop I have got it from is willing to replace it but the colour is no longer available. I chose a "select colour" but we don't particularly like the current select offerings and want the prime mat black which is a "prime" cololur and cost more. The shop is charging us the difference which I think is bad practice but they aren't willing to replace the footmuff. This cost around £100 and I got it to match the pushchair. Should they replace that as well as it wont match anymore? I think it should but was looking to find some rules that confirm that it should be included but am not doing very well with it. It also matched the car seat but its probably a bit much asking them to replace that as well. It was all bought in the same order.

    Was your original pushchair a 'prime' colour which cost more ? If not then they're no liability to replace with the higher priced item because you don't like the colour. For the 'accessories' part I can't imagine you'll win that unless it was advertised/bought as a 'package' but I'll defer to anyone with greater legal expertise on that one

    Thanks for coming back to me. I it was not a prime colour it was a select. I can understand that they wouldn't have to swap to a prime colour but for the inconvenience it would have been a nice gesture. Its the foot muff that is the main concern as That will be a different colour because they don't do the blue any more. Don't think it was a package.

    If  bought separately then  they would not be obliged to  match them.

    A free £100 foot muff is a bit more than a nice gesture.

  • The nice gesture is for the £15 price difference from my "select" price to the "prime" colour. 
    As for the foot muff I just thought that as their product has failed in warranty and they can't replace the pushchair with the same colour then why should I then have to pay for a new footmuff? I don't see why I should have to pay another £100 because they can't replace the pushchair with the same colour. 

    It isn't the car interior it is the baby seat in the car;

    Not everybody wants or needs a matching footmuff.   Think of the stimulation your baby would get  seeing  different colours.

    Unless bought as a packaged item (as in they all come together under a single priced item), they would not be responsible for matching accessories. They could just refund you a proportion of what you paid, which would potentially leave you worse off than you are now, or perhaps better off if you could find old stock of the colour you have elsewhere.

    Sounds to me they are meeting their legal requirements. Anything more would be good will.

    Be thankful its just a £100 accessory... many people buy matching appliances for their kitchen etc and (extended) warranties are purely subject to their T&Cs which almost certainly only cover the failed item and not its matching siblings. 

    Personally I did argue with JL that I bought a "set" when it came to our fridge and freezer and did get an out of court settlement on both items but the critical thing was they were bought together on one invoice (though listed as two items). At the time their best offer was to replace the stainless steel metal freezer with a white plastic one with no offer on its matching/working fridge.
