Loft conversion/ renting

Hi Everyone I’m after some advice for my uncle . His family member  is paying for a lift conversion in my uncles house for him to live in , he will be paying my uncle rent and all bills will be included  . What my worry is where they would stand legally if things didn’t work out with them living together ? As in ownership of the house will my uncle own the loft conversion as it’s in his house ? Would his family member have any claim to the house as it’s adding value by having loft conversion ? I’m concerned as I think they should have some legal document drawn up between them both . Thank you for any advice in advance

    If it's owned by one person then it's owned by one person.

    Why is the family member paying for the loft conversion?

    It's a big investment for no gain. They could pay rent somewhere else without spending tens or thousands to do so.

    Unless they are registering it as a loan or something legally (which assum they aren't if they are then going to pay rent)

    What do they get out of this?

    Does uncle have a mortgage?

    Has anyone checked re permitted development/planning and building control?

    I think the family member is foolish to put money into uncle's house, but is the family member hoping to acquire rights to the property, inherit at a later date?

    Having a resident family member is often a nightmare when it comes to executing a will, even if the property has been left partly or wholly to others in the family.

    It could get messy in the event of a later dispute, as the relative may claim there was a common understanding that (s)he was to acquire a beneficial interest in the property as a result of paying for the works (investment).  Would be best to have a written document recording both parties’ intentions at the outset as evidencing what was meant years afterwards without one would be very difficult…
  • Family member is paying for loft  conversion as he has sold his house and wants to retire on income . My uncle will inherit the lift conversion as the said family member has said it is his inheritance when he passes away uncle will gain on value added to property . Yes my uncle does have a mortgage

    When you say Lift conversion I am picturing a Stannah stairlift!  

    Loft conversions are a different matter though and can often cost £40k-£60k...

    Whats stopping the uncle throwing the family member out after they have spent a huge amount of cash on a loft conversion ? by the sounds of it he will only have the rights of a lodger. Its a bit of a risk spending 40-60k with no security
