    Why would he even need to do all of that? If he doesn't agree to sell the house, then that's that. Not much sense in bothering to arrange viewings on an unsaleable property where the joint owner does not agree to sell - would be a waste of everyones time.

    As for the court route, I don't know why many necessarily assume the court would automatically rule in the OP's favour.

    Half the parties want to sell the house, and half the parties don't. If you consider on balance that the OP's partner may suggest that the OP is fully able to return to the property, and that the OP's request to sell the house quickly would put them in hardship, whereas the OP could (potentially) travel without selling the house (but would prefer not to).

    This is why the context is important, it's a shame the OP hasn't returned to the thread.
