Hi Everyone, thanks for all of your replies and sorry for my absence. I have contacted several solicitors to get quotes, and if I ever get this complete I hope to update this thread with my experience.
Have a good weekend!1 -
Don't think this point has been answered. It is standard practice for such death in service schemes to be paid at the discretion of the trustees of the scheme, because this approach means that such payments are normally tax free precisely. DIS lump sums in respect of very high earners with very high pension entitlements may be subject to tax unless the scheme is set up as something called an 'excepted' life scheme - something your employer could confirm if this applies to you.eltisley98 said:
2b) likewise, our employment death in service benefits will make lump sum payouts in the event of death. The service itself allows to make a Wish about the distribution of the lump sum, but it is to be executed by the Trustee of the Pension service who can make discretionary decisions. We are unsure whether it is better to make things more formal in the Will, and whether this will cause conflicts since it is already in a Trust.
Not sure what you mean by 'making things more formal in the will' - you can't dictate to the trustees what they have to do, but be assured that if you leave your DIS lump sum to your surviving spouse/children, trustees are most unlikely to overturn such an Expression of Wish.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0
