TA6 form question 14.1: Any point to this?

14.1 on the form is "Is this sale dependent on the seller completing the purchase of another property on the same day?" [i.e. is there a chain].

Has anyone had experience of any successful recourse against the vendor if they fill this in to say no, when actually the answer is yes? I've spent ages reading online and property misrepresentation claims appear to only apply (or are worth taking forward) if something significant such as "Has the property flooded before" is lied about etc.

Our decision to go with X property was due to "no chain" when this clearly wasn't the case. All vendors these days say "Oh we're going into rented and moving ASAP" then nothing happens for a year!

    Did you hear that the situation had changed before contracts were exchanged, or afterwards?

    Hello, thanks for your reply. We have not exchanged yet, although we have tried to suggest doing so with a back dated date to no avail.

    I can't how you could have a claim if you don't exchange contracts. I doubt it's intended to be enforceable in that way, just for everybody's info during negotiations.

    Yes it appears that in this country, everything is completely meaningless until you exchange. Having an offer accepted means f all!

    I don't think you have anything to go on then.  Things can obviously change between sending you the form and exchange.  As long as they inform you of them by the point of exchange, they've done what they need to.

    Why would you want to exchange with a backdated date??

    The idea was to define a fixed completion date in X months but that failed as they clearly had no intention of moving out and renting.

    Circumstances change, for all you know there may not be anywhere suitable for them to rent. Not everything has to be based on lies and deceit. Your options are to pull out or wait until the chain is complete.  You have absolutely nothing to stand on with regards forcing anyone to do anything in the same way if you lost your job prior to exchange and couldn't afford the mortgage anymore the vendor could not force you to exchange.

    The system needs overhauling but ....... people tend to present another myriad of lame excuses.
    Your life is too short to be unhappy 5 days a week in exchange for 2 days of freedom!
