Return on line swimwear that’s mis-sized

Hi can anyone help. I’ve bought 2 prs Speedo Mens swimtrunk/shorts on line, from a “sale” site - not a Speedo site (am I allowed to say name?). The small print says no return of swimwear (hygiene). My question is can I return them as they don’t measure the size that I purchased ? When I opened the package I genuinely thought I’d been sent boys not Mens trunks at first. I compared them to the size 34”pair we have already at home (bought from Speedo) and the new pairs I’d ordered both look significantly smaller and they have different waist measurements. The new ones only measure 29” round the waist, their label says they are 34” - I ordered 34”. It’s not just the waist that’s small, the width of the leg is small too. Despite their No-return policy, am I in my rights to return them? They haven’t been tried on.

Surely trunks would have an elasticated waist, meaning that whilst they're not being worn the waist size would be smaller.1

I had a similar issue recently with underwear. Labelled exactly the same as previous purchase, and the same style. They were nowhere near the size of previous purchases. 'At rest' they were the same as the previous ones, but there was far less stretch in the waistband and I could hardy get my leg into them. Fortunately they weren't expensive so I didn't try to return them.

If they have sent you the wrong size then as soolin says they are not as described. The seller can require you to return them (at their expense) and they must then replace or refund. You must make it clear that you are returning them because they are not as described and not because you have changed your mind. However if they are genuine Speedos and the label says 34" the seller will probably argue that they are the size you ordered.
The waist size means 'to fit 34" waist', not that they are 34". As Ergates says they need to measure less than 34" otherwise they would just fall off in the water which is probably not what you want.
Are you sure they are not counterfeit?1
