Scotland keeper liability

Hello, can anyone help me understand if there is now keeper liability in Scotland for car parking charges. I read that the new transport bill could have made changes to the keeper liability but finding it difficult to clarify. Citizen advice website still says no automatic keeper liability? Many thanks 😊

There is currently still no keeper liability in Scotland.
There will be when the legislation to support the Scottish Transport Bill becomes active, probably next year when the new mandatory parking code of practice comes into force.
You can thank your dear leader and Scottish MPs for voting that in. We've had it since 2012. A law that allows someone who was not in the vehicle at the time to be liable for a charge from an unregulated private parking company. Someone who could be at home in bed, in hospital on a ventilator, on active service overseas, or on a gap year in Australia, can be liable for something done by another person.

Not as yet. It is lined up in the new Act, but it needs the supporting Parking (Code of Practice) Act 2019 with its new appeals service fully in place before being completely implemented. Looks like the back end of 2023. It will not have retrospective application.But it's coming and many Scottish motorists will need to reappraise their parking practices.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Good afternoon, I have had a good root about on the government website and legislation website about whether the transport act section 8 keeper liability section has come into force yet and cannot find the answer. I have used this site for years and have had no need to post because it's all here already but am stuck with this. Thanks for all the great info so far and hope someone can help with this one, cheers,
