Paying holiday deposit by PayPal, then CC, S75 protection?

For some reason on website when trying to pay by credit card for a holiday deposit it’s failing. However there is an option to pay by PayPal. 

My PayPal is linked to my debit card, and I’ve read about maybe/maybe not on section 75 when a card is linked. 

So I’m wondering, if I pay a deposit for a holiday by PayPal, then pay the balance (which is £1000’s, so over £100), would I still get section 75 protection?

Just not sure on paying on PayPal, as never spent that much and mostly used for eBay etc, lower amounts. 

I know PayPal has its own “buyer protection” just not sure on big amount, and for holidays etc. 

Any advice please?

    I wouldn't, but I stopped using PayPal years ago because of all the ways it can be exploited and the added complexities it introduces unnecessarily if the contract goes wrong. 

    PayPal can break card protections because while it appears a seamless transaction of payment from you to the business, what is normally happening is you are instructing your card to pay PayPal. Separately,  you've also instructed PayPal to forward those funds to the business. In cases where you weren't logging into a PayPal account and they were just acting as a card payment processor, it was seamless. But it involves a detailed analysis of terms and conditions, relevant facts etc to determine whether the card protections remain intact. 

    You say the payment is failing via card direct. Why? Problems accepting card payments can be an early indicator of financial problems in a business. I'm not saying that is the case here. It could just be a cookies issue or a payment processor issue or your bank refusing the payment because something doesn't match. Just wise to exercise a bit of extra caution.

    It’s TUI, not sure why failing as I’ve tried numerous different browsers, different computers (Mac and Windows), different credit cards, and just doesn’t go through. 

    I prefer using CC, and prefer to book online myself. Could go to shop or telephone, just prefer online. 

    I’d prefer not to use PayPal but it’s last option, it may fail as well.

    Break in the buyer/seller relationship issue aside, one other point - Section 75 is for credit cards only isnt it?  You mention debit card, so that wouldn't be eligible.

    Only something has to have been paid directly with your CC and so that proposal would be fine however if you dont know why its not working now there is no assurances that it will work when you come to pay the rest and naturally there would be no S75 protection between now and when you make the next payment if TUI were to fold etc.

    The issue with PayPal and S75 is when you use your account as technically you fund your account then pass to the third party's account and then they move it to their bank account.  If you are fully logged out and the merchant allows it then making a payment via PayPal in that form shouldn't break the S75 however you may have a fight on your hand with the bank if you end up needing to make a claim.

    As @Ebe_Scrooge said in another thread.

    That's what travel insurance is for.  Remember the old mantra - S75 gives useful protection, but it's no substitute for comprehensive, purpose-designed insurance.  Buy proper insurance, make sure it covers all the risks you need.  Sure, it's an added expense, but it'll be peanuts compared to the cost of the holiday.

    Very good advice. S75 is not the get out of jail card many people think it is.


    Odds on payment is failing as retailer has not implemented 2FA as required now. Or there is a security block on your card (ring bank & check)
