Civil enforcement Ltd gone to DCBL - Urgent please help!

hi all,

my fiance recently got a fine for inputting the wrong car registration into a car park for the gym. The gym does not own the car park. The fine was passed onto the gym who had explained they would sort this out, which has not been the case and now have received a final reminder of the charge and that the next stage will be court. If I had known the gym didn't sort this out, I would have disputed this myself. Now I am unable to and my fiance wants to avoid court. is there anything we can do? the gym mentioned they will confirm to the company that he is a member but unsure how much that will help at this stage.

Please help as the family are urging him to pay this today which I don't agree with

No, I do not agree either. Even if you were going to pay, this would be a 'keying error' which BPA says should be around £20. Also, it is not a fine, it is an invoice, which makes a big difference. Essentially it means that you owe nothing until/unless a Judge says you do.

Did you get the original NTK? Is this now a 'Letter before Claim'? Which parking company and where? The NEWBIES thread will tell you what happens and how to deal with it

Yes he did but he doesn't have a copy of this. If I had known I would have kept and disputed myself.

It is a final reminder letter and that next stage is court.

They have raised it to £170!!!

It is in Bradford, at Snap fitness gym car park. It is frustrating I cannot complain to the landowner as I don't know who it is!!

Right, calm down and YOU DO NOT PAY DCBL £170 ... OK
DCBL have added the fake £70 either as debt collection or damages ?

IT'S ALL A FAKE and the courts do not like fakers

From what you say the letter is from DCB LTD and not DCB LEGAL ?
What has got your family into panic mode is the logo "Can't pay, we'll take it away" ???
NO SURPRISE THEN TO LEARN ,,,,,, NO THEY CAN'T, it's just a very poor method to make you pay

We need to be certain on the type of letter ..... assume it does NOT contain the words .. "Letter before Claim" giving you 30 days to respond
If not then it's a silly debt collection try on which you can ignore.

You should now take that letter to the gym showing them that "this must be the added bonus to their membership ..... to get scammed".
The Gym will know who their landowner/agent is and they will rent from them. Insist the gym arrange for the ticket to be cancelled and you need this in writing

WHO IS THE PARKING COMPANY ?

The fake £70 add-on has been BANNED by government in the new code of practice .... government saw it as a scam

That is now your first step. Also worth telling the Gym that these parking scammers will destroy their business.  The GYM needs to act now

Let us know and do not be intimidated by DCBL

Since their first effort failed, has the gym been asked a second time to fix this?
That is by far the simplest way of getting this resolved.

The family are wrong.  Why would anyone just pay?  There's no CCJ risk (if posters follow all our advice and defend the court claim - fairly easy) and this was a keying error that CEL should have identified.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@KeithP apologies I never got back to you! I took it up with the gym and they got the fine cancelled. Despite initially insisting they couldn’t do anything. Thanks for your help guys.

Thanks for the update but you are still calling it a fine which elevates these scammers to some kind of "authority". You should know that they are nothing of the sort and are just bottom-dwelling scammers that try to scam their gullible victims out of money.

Please, never, ever, call these speculative invoices over an alleged debt for a breach of contract from a private parking company a "fine".
