I have written to the managing agent stating that i intend to take the parking company to court and requesting that they remove me from the enforcement scheme but of course they have not replied. I now face the prospect of the car park management company taking me to court and me losing and facing a hefty bill. I have been advised by a legal advisor to pay the initial charge with a letter saying 'i am paying under protest' as i intend to take them to court.
The IAS have stated that i failed to provide evidence of my ownership of the face but they are not allowing me to respond with such proof.0 -

What will you be 'taking them to court' for? What do hope to achieve by paying them money now? You're unlikely to ever see it again.
If you don't go further with it, by paying them, the PPC will see you as fair game for more tickets as you have already made one payment, you'll possibly pay again. They might even argue that by having done so you have admitted culpability.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
