Who to complain to about TM Legal Services

Hello,

Hope I am posting this in the right board. I have an ongoing dispute with TM Legal Services who are chasing me for a couple of debts. I've asked them to provide proof of the debt, they have sent through the original credit agreements but the amounts on the paperwork don't match what they are claiming and they refuse to give any further evidence of the extra money they claim

I've tried complaining to the financial ombudsman but they have said that the company aren't under their jurisdiction. I've tried the legal ombudsman as TM Legal Services are regulated by the SRA, however they won't accept the complaint either as the company hasn't provided me with legal services. 

Is there anyone else I can complain to to look into this for me? I'm tempted just to allow them to take me to court knowing that they haven't been able to provide of the right amount claimed.

Any advice would be gratefully received.

    I don't see anything to complain about from what you've told us. They're acting on behalf of whoever the creditor is (presumably you've been told who that is?), who think you owe them money. They're entitled to write to you about it. If you dispute the debt, the court is where it gets decided.

    They claim whatever amount the lender advises is outstanding.

    Have you contacted the lenders to establish how much is outstanding?

    And then they will add their fees, you don't have to pay it but if you don't and end up in court the fees will start to get eyewatering.

    This seems to be a grey area - consumer credit debt collection activity is regulated by the FOS but what happens in these scenarios is the solicitor claims to be acting as part of litigation which is not under the FOS remit. The SRA won't deal as you are not a client of the solicitor and the SRA will only look at specific issues which wouldn't include this.

    I would return to the original creditor and complain to them - they should then give you FOS escalation rights, if they refuse to deal with you (perhaps if they've sold the debt on) then hopefully the FOS would recognise that the creditor has put you in a situation where you don't have a right of escalation of your complaint and review the whole complaint.

    There's little chance of finding out, the OP only ever made 2 posts and hasn't logged in since making the post before yours. If you have an issue I'd suggest you start your own thread, explain what the problem is, and ask your questions there.
