Right to cancel?

Seven months ago we bought a design and install bathroom package from a well know store. The various items were delivered but the original March installation date was cancelled by the installer. Not only have we been falling over sanitary ware for weeks while waiting for him to get back to us with a new installation date, but we’ve now discovered that some of the items are too big for the available bathroom space, this because the designer ignored our measurements and the installation survey didn’t pick up the designer’s mistakes. The store’s suggested remedy is no more fit for purpose than the oversize bathroom we’re storing, and they’re pushing back against our suggestion of a redesign. We’ve lost all faith in everyone involved and ideally we’d like to back out of the whole thing and start again with a new supplier. What recourse do we have?

    What remedy are they proposing?

The shower tray is rectangular and the walk in shower is entered from its long side. The tray they have provided is 200mm too long. Principally they’re proposing a shorter shower tray, which would perforce be placed so that as you stepped onto it from its long side the rim of its short side would be partially under you right foot, i.e. you would not be able to place your foot flat to the ground without contorting. Our son has mobility issues - of which the designer was aware - and this would simply not be acceptable. I should add that you would be unable to step onto the shower tray from it’s short side because of boxing for a stench pipe which the bathroom designer failed to account for despite the measurements we supplied including it (hence the too long shower tray). The installer picked none of this up during the pre-install survey.

can you confirm it is a package ie design, supply and install all one contract.

some contracts have installation as a separate contract with the installers direct

Yep, one package. Any additional work, e.g. tiling, was by agreement with the installer (to date we have no paperwork from him of any kind, not even an estimate for that), but the design, sanitary ware, shower etc., and installation of same was all in the one contract.
