Getting CCJ set aside for parking ticket even if I didn't let DVLA know

  • A quick question guys and girls. How do receive my fees back? The judge said I'll have the money by the 20th but no one has contacted me. Just want to check it's not my responsibility to contact them first

    Personally id give it to the 1st week new year for mail to clear as had a case due at manchester CC yesterday but the case was struck out as claimaint failed to pay trial fee. Letter sent out on 6th but only received yesterday so post is very delayed

    The claimaint should pay you directly.

    I'm glad this has been useful to some people. Just a heads up, due to the amount of pages you'll have to go and file the paperwork in manually to the county court.
    Hi Brokencheif, glad you got the outcome you deserved! On the above, is this just a case of printing off the skelly argument and 4 relevant case laws and dropping them to the court where its being heard by hand?

    Hello all, it’s been a while, I hope my case was helpful to others here.

    However, I’ve just received a Notice of Debt Recovery from DCBL regarding the original CCJ that was successfully set aside in 2022. Their offices are closed now, but I’ll be calling them tomorrow to find out what’s going on.

    The notice refers to the same judgment date as the original CCJ, which suggests it hasn’t been reissued. From what I understand, it’s very unlikely they could have reinstated the original CCJ without a court application, and even if they had tried, we’ve received no notification of this at all.

    I’ve recently bought a house, and the two addresses I’ve lived at since the CCJ was set aside, were both mine and my partners parents homes. So if any legal correspondence had been sent, we almost certainly would have received it.

    Has anyone experienced anything similar, where a previously set-aside CCJ somehow gets chased again?

    Did they ever pay your fees as ordered?

    What happened to the actual claim when the CCJ was set aside? Was the claim struck out - what did the final Order say about it?
