New car
Hello to everyone, and thank you in advance for your advice.
I have recently taken delivery of a new Motability car (30/03/2022). Within the first week the seat has deformed to the point of being very uncomfortable to sit on and drive. I took it back to the dealer and said they have never seen or come across this problem before.
They have agreed to resolve the problem, repair the seat etc. My question is what rights do I have regarding not fit for purpose, not sold as advertised, should they be taking the car back and sending it back to the manufacturer to get a replacement. I am new to this forum so please be kind in your response.

It sounds like the fault (which sounds like an uncommon issue) will be resolved.

If they're going to resolve the issue then what's the problem?
Yes, you're within the period in which you could reject the vehicle for a full refund but how's that going to help you in the short term, you may as well just let them repair the seat, especially as it sounds pretty straightforward, ie replace the seat with a new one.0 -
Motability is essentially a lease, so they should be providing you with a suitable courtesy car whilst the dealer fixes the issue with the seat. If it's resolved, then you're good.
If it's not resolved, or you want to change the car anyway, then you'd need to speak to Motability who own the car and can sort something.

Just think for a second, if it’s fixed your ok.
If not, and you send the car back how many months could you cope without a car.
My dad’s motability car is 3 months past changing time and still no firm date when his new one will arrive.
His previous one was a C class estate that was taken back to the dealership on a breakdown wagon 11 times in total
over 3 year.
3 new batteries fitted and they still could not find the issue.
7 times the automatic gearbox stopped working.
plus the parking brake stuck on.
So needing a new seat pad is not to bad.
Ive replaced several on my old rover cars as when I got them they had done 100k and I wanted to do another 100k.
£80 for the base and 1 hour later nice comfortable seat.

You don't have any rights regarding the dealership.
Motability own the car so you need to discuss the issues and options with them. It is up to them what action they take to resolve the issue. They are usually fairly understanding.0
