Met Parking - Heathrow McDonald's, Hayes - double dipped - VICTORY appeal stage

Appeal victory
I recently helped a friend who got a Postal PCN from Met Parking after being double dipped on their ANPR which. He'd attended the Drive Through twice in an evening - once before and once during his shift. They sent him a PCN with only the first and last exit times - their usual MO!
Anyhow I wrote out his appeal pointing at that as Keeper he categorically denied the false allegation of his vehicle being on site for over 300 mins! He could prove his vehicle was elsewhere- but not willing to do so at this stage, I also pointed they had committed a Data Breach by accessing his details from the DVLA, failed to follow BPA procedures by doing their checks on ANPR to rule out double dips. K also informed we would be reporting this Breach to McDonald's, DVLA and the BPA etc! I included a screenshot of the BPA CoP and told them we expect this "charge" which was "incorrectly" issued to be cancelled , that we strictly forbid keeper/ vehicle details being passed onto anyone else and for them to Cease & Desist now - and own their "mistake". I pointed out this "mistake " seems to be a very common and regular
One which has reached national media countless over the last 15 years!
They wrote back today cancelling his charge. But there was NO mention of any accountability as to why it happened, no compensation nor any mention of any self referral to ICO - despite Met cancelling - the matter is far from over! 😉
Just putting this up for reference point for any future victims of Met (or UKPC) at McDonald's at Heathrow (or any branch they've visited more than once in a day) which I'm happy to assist others with.

Once I've assisted my friend filing the appropriate complaints I'll update accordingly re: any responses.
This 100% shows just what chancers these lot are - ignoring their own ATAs rules, breaching DPA and trying it on until they called out, held to account and threatened with action! They've probably dropped it quickly because they think we'll let it go and are smart enough not to try it in court.
Sadly they still get enough people who are frightened into paying, I'm going to leave a Trustpilot and TripAdvisor reviews as well as complaints to DVLA, ICO, Action Fraud and Met themselves.5 -
Nicely done - and encouraging that the RK, not just content and relieved that the charge has been dropped (as 99% of those who come here are), is prepared to go on the offensive. If only the majority did this the landscape might look a good bit different.Well done @95Rollers on getting your friend through and hopefully beyond the initial stage. When you first came here on your own case I said that you seem to be 'spikey' (had to make sure that I'd included the 's' in that 😮), and you're certainly proving it! Look forward to updates. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
