    My mistake. N180 is the directions questionnaire. 

    N149a is the notice of allocation.

  • Ah, my mistake - I see the Directions Questionnaire is N180, cheers Fruitcake.
  • Sent back N180 saying I wanted a court hearing, not mediation.  Just had long chat with land agent that used to manage the park, he was very helpful but couldn't do anything re getting claim stopped as no longer manages it, but highlighted fact that if I go to court there'll be no proof that lady I was a carer for was in the car with me, doh! That had never dawned on me as I knew she was and that was enough !!  What to do now, I wish I'd paid up originally ....

    You can attest that she was, the Claimant was not there so will find it difficult to challenge. In any case, a statement from her under the correct statement of truth would help.

    I thought I'd draw your attention to this fairly recent thread which you might have missed. You must keep going through all the necessary court procedure phases, but the hope is that your case ends like all those detailed in the thread. 

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    You can attest that she was, the Claimant was not there so will find it difficult to challenge. In any case, a statement from her under the correct statement of truth would help.

    You were a witness to the alleged event. A witness statement signed with a statement of truth will carry weight with the judge. As Trainerman says, a brief WS from the passenger will add more weight to your defence.

  • Thank you both, I no longer have any contact details for her and the payroll company who dealt with wages won't give me her contact details as I'm no longer working for her - aaargh!  I do have a payslip though

    You could ask the payroll company to pass your details to the lady concerned and ask her to contact you.

    It's no big deal if it doesn't help. You were a witness, possibly the only witness to the alleged event, and your statement will carry weight with the court/judge who will decide on the balance of probabilities who is telling the truth.

    It's fine. Stop worrying about not being believed.

    You will be the only true witness at the hearing (if it even goes to a hearing).  The case is the burden of the claimant to prove, not yours to prove.

    The land agent hasn't a clue how court hearings work and how fair most Judges are, and keen to hear from proper witnesses.
