DCB Legal Letter of Claim

So I have received a 'Letter of Claim' from dcb legal from parking on yellow lines back in 2019

I have seen a couple of threads regarding this but im not very IT savy im afraid and dont know what a lot of these terms mean. I also care for my disabled wife.

Should i just pay the dam thing and be shot of it?

    Which parking company?

Plan A is always a landowner complaint, plus a complaint to your MP.

You should also email the solicitors, quoting the PCN number and claim number, telling them that although you deny the debt, you are seeking debt advice and therefore require the case to be put on hold for 30 days in line with the pre-action protocol for debt claims.

Thar will give you some breathing space to get yourself up to speed.

You should also send a SAR asap as per the advice in the NEWBIES to the parking company. This should flush out the original NTK and all the other information they hold about the keeper, including images of the vehicle.

You should read the sticky Announcement for NEWBIES, starting with the fifth post that has a list of acronyms and abbreviations commonly used here.

Then you should read the guide to court written by bargepole that you will find in the second post of the aforementioned NEWBIES.

When and where did the alleged event occur? It may have cropped up here before.

At this stage you should not reveal the driver's identity. Only ever refer to The Driver and The Keeper, who are different people as far as the law is concerned. The Keeper has protections in law that The Driver does not.

  • Ok Thanks.

Its for New Generation Parking Management Ltd £160 they are claiming i owe them.

I remember ignoring the original 'fine' years ago thinking it would go away. I have moved since then and all..

The location was for Malpas Road Newport, South Wales outside a Tesco's store I remember parking on the double yellows there but i had no option as my car was breaking down and it physically couldn't make it into a parking bay.

I will do what you suggested.

    Thank you.

If you have proof of a vehicle breakdown, then that will help if you get a ticket.

Whilst you say you will do what I suggested, you haven't followed my suggestions with regards to not identifying the driver.
Parking companies read this forum. If you are not careful, you may at some point give enough information for the PPC to identify you.

Once you have created breathing space, in addition to reading the guide to court, you should read the template defence that is 95% written for you. You will find that in one of the sticky Announcements at the top of the forum.

Right - IMPORTANT - when you email the SAR to the DPO of the parking firm, you MUST also tell them and DCBLegal to 'erase' your old address because you do not live there and it is not good for service of a court claim.  Attach a copy of a utility bill.  Confirm which address is correct.

If you don't do that, you could get a default CCJ behind your back if they decide to revert to the old address for the claim.

If course you don't pay £160 to make a scam go away.  We will help you fight it. No risk, as long as you follow all our advice, and comply with court letters/deadlines.

We win these cases.  We do this every day.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OP, have you based your forum username on your real name? If so, you may want to get your forum username changed to something completely anonymous.

To help with that, have a read of this item from the Forum's FAQs:

    Can I change my username?

In most circumstances, we don't allow this.

The only reason we will change your username is if it puts your privacy at risk e.g. you've inadvertently registered using your name, email address or something which gives away your identity within your username.

If you fall into this category, email forumteam@moneysavingexpert.com your current username, the email address you registered with and three alternative usernames in order of preference.
