Need to change circumstances as my husband condition as gotten worse since they took his living component off him and my carers allowance we called them up and told us that would need to do a new claim and we may loose some money as need to look at whole claim not just living part we may loose all or part of claim is the correct or was she just scaring us in not claiming

If he is still receiving some PIP it is a change of circumstances and it is not a new claim.

If the decision is recent and you believe it to be wrong you should be challenging the decision by requesting a Mandatory Reconsideration. You can do this as long as it is not more than 13 months since the decision was made.

For a change of circumstances or an MR they will look at the whole claim again. However it would be unusual for an MR to result in a reduced award. Usually an MR results in no change at which point he can appeal to the tribunal service which removes the decision making power from the DWP and places it in the hands of the tribunal.
