Ok thanks , what are the chances that I will lose ? As it will then be a £100 fine, also , any idea why other people who sent the same pasted letter had their fine overturned straight away

It's not a fine.

You shouldn't lose at PoPLA even if the initial appeal fails as long as the driver's identity is not revealed. The keeper does everything and the driver sits on their hands and says nothing.

It doesn't matter if you lose because APCOA are benign, and it will time out after six months anyway so leave all your appeals until a couple of days before each appeal deadline.

Ignore debt collectors.

You won't ever pay a penny!  

It is not a fine. and because they've called it a 'penalty under byelaws' it times out after just 6 months, so obviously you use the POPLA code on the last day (which is day 32 or 33...POPLA Codes last till day 33 despite what the POPLA website says).  This gets you closer to the magic 6 month limit, of course.

Ideally get some photos in the dark showing the lack of lit signage, if this trip was in the dark. They can be included in the POPLA Appeal in late March.

Can you get a few photos in the same lighting conditions?

Alternatively just ignore APCOA and like I said, it times out and nothing can happen.

It's not a real byelaws penalty and APCOA don't have the standing as landowner to enforce it (because they are not the landowner).  Nor is it a contractual charge.  It is neither one thing nor the other.

Perfectly safe to just ignore the daft demand letters if you can't be bothered with a POPLA Appeal in late March on day 32 or 33.

Hey guys, pretty sure I got got by this the other night. 

Went to pick someone up, probably been a few years since I did. Drove down that road at Brighton station, got to the roundabout at the end, then saw some signage saying taxis only. Drove straight back out (maybe stopped for 10 seconds to read the sign, didn't pick anyone up though), then drove back up the road and parked opposite the Jury Inn before the sign that said 'Taxi permit holders only past this point'.. Although I'd already driven past it before. Stayed there for a bit. Then about 50 taxis all turned up at once, and yelled at me, and oddly blocked me in while also telling me to move. So I moved, but had to drive BACK down the road to turn around as there were now so many taxis and no way to turn in the road without passing the camera again. 

Just waited somewhere else on double yellows in the end. But the camera will have got me, I reckon. Twice, probably. 

Anyways, seems like such a trap. Google maps shows it as pick up point, there's even signage at the first roundabout saying pickup point that way. Then there's one unlit sign to say it's some toll road for taxis only. 

Anyways, just deciding to proceed when I get my fine through the post. 

I was driving so I guess I just admit to being the keeper, and say the driver won't be named, rather than saying I wasn't driving. Ideally I would like to not lie, other than by omission lol.

Why do you have to lie? All you have to do, if you are being pursued as the RK for a non-POFA PCN is to say that you are the RK and you are under no obligation to name the driver. End of!

Do you think the claimant has a big database somewhere with the picture of every driver in the country that they can refer to? Without giving the drivers details (as you are invited to do) they have no way of knowing who the driver is and they are put to strict proof as to who the driver was. Do you get it?

Okay, I'm not a lawyer so I have no clue. 
I just figured best not to directly lie when possible.

I'll see what picture they have. Unfortunately it might actually be good, as I parked right in front of the camera 😂

Was dark though, so maybe not.

You need to start your own discussion for us to help you properly. It has already caused confusion today and it is unfair on @nsr500rossi to hijack their thread which is all about their case where they were not driving (nothing like your case).
