ive googled westminster council and there appears to be a process for such things i may well leave it and see how my recovery from the op goes.

Accidents happen. People fall over their own feet. Just because there’s an injury it doesn’t automatically follow that there’s a claim. 

I concur however i didnt fall over my own feet if i did i wouldnt even consider making a point of this.

That certainly used to be the case - whether it still is, I don't know.

(It was something like - less than 125mm/half an inch then there was no hazard, but if greater than 250mm/an inch then you either should have avoided it or you were up to 100% contributorily negligent.  So it had to be between the two for a claim.  Not sure if those were the actual measurements used)
