  • Thank you again for all the guidance and advise on this, I have gone ahead and submitted the defence and received an automated CCBC AQ Acknowledgment, as well as acknowledgment from DCB Legal.

    I will now await any further news and look out for the questionnaire from the CCBC, is there any particular timeframe for when I should expect to see this?

    In the meantime, one of the contacts at the landowner has come back to me stating that they've passed my complaint on to the relevant person who will be in touch in due course. I've also spoken with them by phone and requested that they give this a chase, so will see if anything comes of that as well.

    The CCBC would normally send the defence to the claimant and give them 28 days to confirm whether they are going to proceed or not.  Keep checking your MCOL status page for progress reports.
  • A further update on this, no sooner had I submitted my defence yesterday than I received an email from Highview Parking in the afternoon to advise that following correspondence received from their client (which I am taking to mean the landowner), they will not be pursuing the matter any further and that the charge has been cancelled in full. 

    So a good result in the end, a big thank you to all those who have helped me get to this point with the excellent guidance given on this forum!

    I assume that I'll receive an official confirmation from the County Court at some stage as well?

    Yay!  ANOTHER HIGHVIEW ONE BITES THE DUST!

    Just shows that it's never too late to try a landowner complaint.  The solicitor should send you and the court a Notice of Discontinuance.

    If the claim hasn't been allocated to the small claims track, then, Highview are liable for the defendant's costs to date.(Part 38.6).

    I'm not sure I have any particular costs to date. I suppose the only thing would be the time that has been wasted on the matter!
