Missold but can't cancel

  • Aren't the only questions:

    (1) whether the "leisure activities" exemption to cancellation mentioned by @the_lunatic_is_in_my_head applies, and if it doesn't apply...

    (2) whether the OP is within the 14 day cancellation period, and if they aren't within the period...

    (3) whether looking4parking complied with their statutory obligation to provide the OP with details of their cancellation rights?

    Hi all, 

    Thank you for your replies.  I didn't buy the parking through looking4parking's website. I bought it through Ryanair's website as an add on while I was buying my flights.  There was no mention of leaving keys in the information presented to me at the time of purchase or in the T&Cs.

    It was only in the confirmation email that was emailed to me after the purchase that it was mentioned.

    I've attached a screenshot if it helps (I booked the low cost not meet and greet).

    It may be fairly common to leave keys but I've been booking airport parking for years (including offsite) and never had to.
    Did you download and read the attached PDF?

    Yes which was the T&Cs for looking for parking.  It said it was non refundable but didn't mention the key situation. 
  • Who is your contract with?  The parking company, or Ryanair?  Which entity took payment and how did you pay?
    The T&Cs say the contract is with the service provider (the car park not looking4parking).  It says the service provider have t&cs of their own but none have been provided and it is not clear who/how to contact the service provider other than a mobile number to let them know you have arrived.

    Ryanair took the money.

    For (1) I don't know how to check if it counts as a leisure activity 

    (2) I purchased the parking on 19 March. I contacted Ryanair through their chat function on 20 March requesting to cancel.  They told me to contact looking for parking.  I contacted looking4parking on 21 March requesting to cancel.  They told me it wasn't possible.  I realise now I haven't contacted the service provider directly.

    (3) Neither Ryanair nor looking4parking did not provide me any details re cancellation rights

    I don’t know how you were miss-sold I just tried to make a dummy booking on the Ryan Air website and it clearly states that you hand over the key for this service. It also states that you car will have secure parking, so it is not one of these dodgy companies who will leave your car in a residential street or a farm yard in the middle of nowhere.

    As someone who once lost the key to my car on an outbound Ryan Air flight to Italy, I am aware that there are risks keeping the key with you as well.

    You weren’t mis sold, it’s common practice to leave the key. 
    If you no longer want to use the service that’s your choice, but you won’t get a refund.

    Sorry OP we didn't expect you to :) 

    Maybe if @unholyangel is passing she might have an opinion on this one.

    If they didn't supply you with any durable information regarding cancelling then, if applicable, the cancellation period is extended to 1 year and 14 days (or 14 days after the trader actually supplies the information). 

    I assume you don't want to leave the key so the car can't be used or moved once parked, which is fair enough. 

    The problem here is that even if you do have the right to cancel it's likely to be an uphill battle so is a question of how much effort you would be willing to go to to enforce your rights (should they apply).
