Missold but can't cancel

  • I don’t know how you were miss-sold I just tried to make a dummy booking on the Ryan Air website and it clearly states that you hand over the key for this service. It also states that you car will have secure parking, so it is not one of these dodgy companies who will leave your car in a residential street or a farm yard in the middle of nowhere.

    As someone who once lost the key to my car on an outbound Ryan Air flight to Italy, I am aware that there are risks keeping the key with you as well.
    I've just made a dummy booking myself and I still can't see where it says about the keys.  Where did you see it?  If I've made a mistake then that's fine.  Perils of booking things in the middle of the night when baby keeps waking up!

    Aren't the only questions:

    (1) whether the "leisure activities" exemption to cancellation mentioned by @the_lunatic_is_in_my_head applies, and if it doesn't apply...

    (2) whether the OP is within the 14 day cancellation period, and if they aren't within the period...

    (3) whether looking4parking complied with their statutory obligation to provide the OP with details of their cancellation rights?
    For (1) I don't know how to check if it counts as a leisure activity 

    (2) I purchased the parking on 19 March. I contacted Ryanair through their chat function on 20 March requesting to cancel.  They told me to contact looking for parking.  I contacted looking4parking on 21 March requesting to cancel.  They told me it wasn't possible.  I realise now I haven't contacted the service provider directly.

    (3) Neither Ryanair nor looking4parking did not provide me any details re cancellation rights

    Maybe if @unholyangel is passing she might have an opinion on this one.
    Car parking strikes me as being a rather dull leisure activity! Bit of a stretch to say it's "leisure" just because you happen to be on your way to a holiday (if that even is the purpose of the OP's trip).

    That would be my thinking as well, I think related to refers specifically to the service in question rather than a kind of bolt on service connected to a separate leisure activity.

    Personally I don't think it's related to a leisure activity either.

    If their own T&Cs say that the booking cannot be cancelled, then I suspect - but don't know - that they can't have complied with their statutory obligation to supply the consumer with the required information regarding their cancellation rights.

    If so, then the OP has up to a year and 14 days from booking in which to cancel.

    I would quote the legislation [see Edit] to them, tell them I'm cancelling as their T&Cs don't override my statutory rights, and say I want a full refund.

    If they don't accept that argument, it's a question of whether the OP considers it worth suing or not...

    [Edit:  1  I put a link to the legislation in my earlier reply.  2  Before doing anything, the OP might want to consider if they have any alternative to this parking provider.  Do they all require keys to be left or can the OP get to the airport without their car]

    And if they didn't provide the required information regarding the customer's statutory right to cancel within 14 days, then that 14 days is extended to either (a) twelve months plus 14 days, or (b) 14 days after they do provide the information.
  • Thank you all.  I'll give it a go and see.  I'm not going to go as far as suing, it's only airport parking after all but I will quote the rights various of you have kindly provided and see if it makes any difference.  I'll let you know how I get on.
