Re PCN number:

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner."




Hi everyone.

Just a quick one. So I got a windshield Pcn on the 13th Feb 2022. I didn't do anything as it was advised on the newbies thread to not do anything till I get a letter through the post. So I received a Pcn through the post on the 14th March 2022. Now before I send the above template, is this OK to do and the correct template as it was mentioned I should reply by the 26/27 days stage?

 It says on the Pcn "If you would like to review this parking charge, within 28 days of receiving this letter, please email etc" 

 But then says underneath; all appeals must be submitted in writing to the above address within 28 days of the date of issue."

I don't know if this is contradicting or wrongly written? 

Just wondering if it is still OK as it was advised to do the appeal by 26/27 days? Many thanks and I'll delete after the answer.

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 8 (2) (e) of the Act nor the statement of keeper liability prescribed by 8 (2) (f) of the same Act.

You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records."

Send the second version if you are sure the PCN is non-POFA, which Horizon ones normally are (but we don't like to assume).

Hi. I actually sent the combined 2 posts respectively in that order and they sent back blurry pics of my car where it was parked (not uploaded here for annonymity) and this little gem below which you can hardly see as evidence. Looks like they've completely ignored my 2nd post of Pofa 2012 included in the appeal and now on the appeals website where I typed my Pcn in for an update and they have just uploaded these pics and looks to allow me to respond again so no verbal written reply just the new images. What should I respond with now?

Just for reference as if you can't read it. It says;

"Premier inn guest parking. 
Per night - FREE

GUESTS must leave by 12pm in day of check out.

Please register your vehicle on the tables at the reception when you arrive. "

There's only basic cctv cameras on the parking site for security purposes (not the number plate readers) as parked there many times with no issue until then. 

It looks like the person has taken this pic by foot as they can't rely on the normal cctv cameras and there's no anpr/camera on site and these are the only signs on site so no mention on how much the fine would be (e.g £90) as you would see on most parking companies for unauthorised parking... .

If you are not yet at POPLA stage, that is next, once you get a rejection letter.

What happened when you complained to the landowner/hotel manager/Premier Inn CEO? If you are a regular guest then you should say you can't afford to stay there again if it comes with a £100 charge every time.

Ah that's the thing. As explained on my previous post, all they've emailed back with is:

"Thank you for your email.

 

Please be advised, you have sent your appeal to the incorrect department, and we are unable to respond to your appeal accordingly.

 

To contest a Parking Charge Notice, your appeal must be submitted directly to our Appeals department.

 

If you would like to submit an appeal, you can do so by completing an appeal form available on our website; www.horizonparking.co.uk  or write to us at Horizon Parking Ltd, Finitor House, 2 Hanbury Road, Chelmsford CM1 3AE.

 

Please include the Parking Charge Notice number, Vehicle Registration, the reason for your appeal along with any supporting documentation.

 

Please be advised we can only accept an appeal from the driver, registered keeper or third party when written authorisation has been provided by the driver/registered keeper."

And because I went to try submit it again, all that's changed is the pictures are now on the website appeal page but no actual response other than above email...Looks like they've re-sent a generic email above and just acknowledged the first post about sending me requesting to send pictures to me. Also that email doesn't take responses as tested a reply email so not sure where to go... Maybe just send the 2nd paragraph alone or just resend the appeal again?

You have appealed to the PPC. Await your rejection and PoPLA code and concentrate on gathering your evidence, whilst you also await a response to your landowner/hotel/MP complaints.

Get your own pics of the site and signage to show how a motorist could easily have missed them. Use Google Streetview images if available.

If you didn't appeal to the right portal, page or email though, then in fact, they are saying you haven't appealed yet.

Not sure why you didn't?  The NTK says how appeals are submitted so do that.  Appeal as keeper of course, not driver.

Hey everyone. Thanks for the replies. 

I DEFINITELY 100% did apply correctly and have screenshots to prove it and the email note my Pcn, car license etc and my appeal but that generic email just stated it was the wrong department (contradicting I know). I think it's either an incompetent person replying with the above generic email and now attaching photos which were never there before when I applied originally on the same appeals page or sneaky tactics because as soon I try to appeal again via their direct email link to www.horizonparking.co.uk it puts me to the exact same screen as the original appeals page to start again with entering Pcn, what you  want to write on the appeal,car license number etc YET now the only difference is it shows the new uploaded said photos of the sign which I've uploaded for you guys to see a few posts earlier and blurry pics of my car and I can appeal like nothing happened before.... 

So it looks like they've sneakily acknowledged (unofficially) or taken note of the first bit of the ;

YET ingored my 2nd post of Pofa 2012 template which was in my original appeal combined with the template one size fits all. 

So it allows me to appeal as if they've not acknowledged the appeal other than sending me that weird email.

 Question is shall I just re-send JUST the Pofa 2012 template now and could I maybe add about the blurry signage at the same time? Hope this post makes it clearer now.

They would never respond to the POFA point anyway, so we'd never expect to see them cover all your points.

If they have not sent a POPLA code and are telling you to appeal in a different way then just put the same appeal in again.

Just play the game to get the POPLA Code.
