Party wall surveyor help

I have spoken to 3 different party wall surveyors who have all given me different opinions on my kitchen extension wall. My own surveyor has agreed a further award with my adjoining neighbours surveyor agreeing enclosure costs are owed to my neighbour. I was under the impression that as we built our own Independant wall with foundations that have a gap between the walls and aren’t tied - I was not enclosing on the party wall.
My surveyor says as my wall is not a cavity wall I must pay the costs.
A second surveyor says that the wall doesnt have to be cavity and can be solid - but I should ammend the wall structure internally and then no costs would be due
A third senior surveyor says an error has been made by the two party surveyors. The wall is not enclosing. Whilst it might be a benefit having the wall there I am not making use of it and my wall is a solid 100mm brick wall with plasterboard and skin with its own foundations with no attachment to the party wall.
I feel like it’s the luck of the draw when it comes to choosing a party wall surveyor which feels unfair - is it right that an appeal out come might just depend on which view the court takes - because there doesn’t seem to be a wrong or right answer?
