Received a court claim for a different business.

Options
Hi.

At the weekend I received a letter from Northamptonshire County court business centre regarding a claim for a business named similarly to mine but of which I have no knowledge.

I really don't know where to go from here. I have tried to contact the claimant's legal representative CST law to explain the problem and asked them to withdraw the claim. They have said they will investigate but were very fuzzy as to timescales and processes in regards to this.

I am hesitant to appeal the claim at this time as I am not named and so do not know if I can dispute the claim.

From what I can see the client's lawyer has the wrong address and has filled with the wrong court and it has only come to me as I have a similar name for my company.

If I was to send an appeal what additional documentation may I need? I couldn't close my certificate of incorporation confirming my business details. I could also link to the company's House record for the company I believe they're making a claim against. They have since changed their name and are based in Stanley according to the companies house data.

I can also send a link to my website showing that I am not in the hotels business but in fact manufacture tablemats and coasters.

Is there any other information that you may think of that I may be able to supply to support my appeal if that is the route I need to take?

Thank you for any help you are able to offer.
Iain

You don`t send an appeal, there is no mechanism in place to do so, you defend the claim on the basis of you not being the debtor in question, if you do anything else you could end up with a CCJ by default.

You don`t have to go in to detail, you just defend the claim on that basis, its up to the claimant to prove you are the debtor, not up to you to prove you aren't.

  • Hi

Thank you. I have called the court which has given me the email address to send my dispute to.  I will do as you have advised and politely say that I believe this to be an error.

    Thank you
