  • Spitting on someone is technically common assault. Not sure what it is if he missed.

    Assault is
    any act which puts a person in fear of immediate and unlawful violence

    You also have to be capable of carrying out the violent act. e.g. if you threaten to kick someone's head in and you don't have any legs it is not assault as it is clear you are not capable of carrying out the threat.
    Added to that, could be the issue of "I don't know that he doesn't have AIDS".

    You can't get AIDs from spitting, well it is so unlikely as to be not a threat.
    And she could pull the "picking on an indian woman" card out, but with the common assault issue that might not be needed.

    Only if she can prove that he spat at her because of her race and not because she was driving the wrong way round the car park.

    She swore in front of the children (upsetting and intimidating them) and was in the wrong to begin with.

    I hope the children are over this incident, but if she goes to the police, do not hesitate to point out that you feared for their safety from this unprovoked verbal assault.

    Where did the fear for safety from this verbal assault come from :rolleyes: the OP never mentioned being in fear?

    Or is this the one on page 45 paragraph 3 of the Bar room lawyers book of what to tell the police in order that they can really understand what a pillock you are :D

    Dont forget that you can also inform the fashion police if she was wearing a loud frock in a public place :T thats one in the eye for her, or at least another one in the eye.

  • And so why make up things ? where did the OP say they were in fear of their personal safety ? He just lost it and spat at her, no excuse, just a chav.

    You are the one juicing it up as a counter complaint to try and make it sound justifiable. So clearly I do understand it.
  • i feel i have to say that the parking signage in the trafford centre is abysmal - with all the building works that change allowable areas to park every ten minutes or so, i've found that i've had to go down one way bits the wrong way to get out of a dead end! it's a crazy busy place and parking there is never fun, let alone at this time of year - don't let your brother go there again if someone getting in the way twice gets him that wound up!! might be worth talking to him anyway - if he's that volatile sober, i wouldn't want to accidentally knock into him in a pub............

    Has it come to this that someone can't even look for a parking space without being abused; and why should it matter who they are?

    You said yourself that you drove around twice so it was obviously busy - why even wind the window down and start on at them, just let it go.

    Maybe this woman driver was in the wrong, but she was probably highly harrassed, (not helped by having kids in the car) and trying to park anywhere at this time of year is a nightmare, especially if it's a strange car park, so it was probably an easy mistake to make. I think your brother behaved over the top frankly, and if he can't curb his impatience and anger when he's driving at nil speed, his behaviour at speed on a motorway doesn't bear thinking about.

    Would have to agree

    There have been quite a few cases of people being spat at in road rage incidents. It is a criminal offence and rightly so
