Hi all
According to a letter the registered keeper received, a driver over stayed a 90 mins parking allowance at a Costa coffee in Essex/ London
No ticket left on the driver windscreen only camera photos in a letter received
Incident date 12th March 2023
Issue date 22nd March 2023
Date posted 20th March 2023
Letter received 26th March 2023
Does the registered keeper have any chance of defending this . it's a company called civil enforcement www.ce-service.co.uk
Letters received (front, back and envelope time stamped)
may I ask what my best defence is ? thanks

The NtK fails to meet the requirements of Protection of Freedoms Act 2012 (Schedule 4) for them to hold the keeper liable.Use the blue text template initial appeal from the NEWBIES FAQ Announcement, first post, just add a sentence reflecting the above and tell them to contact the driver, who you have no obligation to identify, nor will you be doing so, and confirm cancellation of their parking charge addressed to you.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

So sorry guys I thought I updated this thread . It turned out They had set the letter more than 14 days after the incident date and therefore I appealed on this basis and they cancelled the charge4

NB: Only works if you appeal as keeper and don't say who was driving (just in case new posters read this, it's important to know NOT to imply who was driving).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
