Loss of insurance excess

Last September I was involved in a car accident, I paid £300 excess towards the repair which is now completed, I have now received news that the other drivers insurance has admitted full liability and hastings direct (my broker) has recovered all its losses, when I enquired about my £300 excess they said it was nothing to do with them and they have past the details to carpenters solicitors to claim my excess they now have told me as I did not have the additional legal expenses on my policy there was nothing they could do so my £300 excess is lost.
Is this normal among insurers, if you don't have legal expenses added on you will loose your excess regardless of fault.

Yes that is correct. You've agreed to pay the first £300 of any claim. It's an uninsured loss so your insurer don't have a duty to recover on your behalf. You're on your own. Why not try to approach the third party insurer yourself to recover the excess?1

If you know the details of the third party insurer, contact them directly and ask them for a payment regards your excess.
