speeding prosecution

Just received a notice of intended prosecution for excess speed by a speedcurb device.
The offence was allegedly back in November and I've only just received the letter.
is it too late for them to prosecute?

Are you the registered keeper? If so, are the details on the V5C correct?
The only time limit is that a NIP must be served on the RK at the registered address within 14 days of the alleged offence.
If you are not the RK the limit does not apply.
The request to name the driver is valid regardless, and you must respond.

They have 6 months to start proceedings, so they have ample time.
  • I am the registered keeper and the address is correct on the V5C

What is the date of the alleged offence and the DocRef date on page 2 of the V5C?

Not if that's the first NIP and the V5 is correct.

Whether it was the first NIP or not and whether the OP can be prosecuted or not, doesn't the OP need to be reminded that he still must reply to the request to name the driver?  (If he hasn't already done so... )

They can still start proceedings, though they would be destined to fail.

I think it's much more likely that it's a reminder. There's an outside chance it was posted in time but has been Covid-bound in a sorting office somewhere.

OP, what is the date on the NIP?
  • apologies - i had the wrong V5c.  I was looking at the one for my other vehicle.  the one with the fine has my old address on it.
  • Date of the NIP is 22/03/2022.  how would they have gotten it to my new address?

As you've failed to respond to the original NIP, they've probably got your address from your insurance policy.

Best name yourself and pay up, it'll be cheaper than six points and a £500 fine for failing to name a driver.
