I’ve moved into a house that had a transferrable guarantee for the windows that’s been passed on by the previous occupiers. I have 4 windows where the seals have failed and they have condensation between the glass. I am within the guarantee period but when I phoned up to query the guarantee and to ask for the windows to be replaced I’ve been told that I should have notified them within 28 days of moving into the property.
There is nothing in the contract to state that I needed to notify them and it is written on the front of the contract that it is transferable.
Looking at the contract it would suggest that I am in the right and they should replace the windows but I’ve been told to put a complaint in.

Without the T&C of the guarantee it is impossible to say whether you are 'in the right' or not.
When you say 'contract' do you mean 'guarantee' or is this something from your conveyancer?

The warranty/guarantee is written on the front of the contract which was signed for the original purchase of the windows. It states in handwriting that it is transferrable and lasts for 20 years.The back of the contract has the terms and conditions. No sections mention me having to inform them of change of ownership.0

Before going any further, are you sure that failed sealed units are covered for 20 years? many guarantees cover different parts for different times, frames 20 years, sealed units 10 years, locks and hinges 5 years...Tall, dark & handsome. Well two out of three ain't bad.0

Here is the contract that states 20 year transferable guarantee and the terms and conditions that are printed on the reverse. Interesting to note that the terms and conditons on the back state that the guarantee is not transferable!

You are going to have to get them fixed in any case. So I would simply let them know they have one week (make it a fixed date by which they must respond) to acknowledge that either they will do this, or else point you in the direction of the 28-day disclaimer. Add that if they do not do so, you will get someone else to do the work, and then SC them. And post honest reviews.Once the week is over, do so.0

10a is the part which tells you . Then the handwriting says different . 28 days I suppose iis a different argument . I would ask for a price to fix them then ask if they would meet you half way (in that order)10 years is a long guarantee for dg units . I give 10 frames 5 glass and 2 hardware
