DCBL/CIVIL ENFORCEMENT LTD

I am a newbie. I received 5 notice of debt recovery letters on 24th Feb. I had no idea I even had 5 ccjs as CEL had been writing to my previous address for 5 years. I have no proof of the alleged parking offences. CEL won't speak to me as they say it is now in the hands of DCBL. DCBL will not discuss the case as they say they only deal with debt. 
I have rang up the county court and found out the information that I need to file 5 x N244. The court informed me I have 3 weeks until DCBL can get legal rights to reclaim the debt through bailiff visits. 
I have read all the threads on here but my situation is urgent and it is daunting having to do 5 x court applications I have been advised by CAB to do one at a time to test the water. I'm also thinking that if I file all 5 together, it will be more worth their while to turn up on the day to defend. It is all making me really ill

    When you spoke to the CCBC did they give you the dates of the CCJs?  Is there still time to pay before the judgements are entered onto your credit record?  (Not suggesting you do pay but it is a factor to take into account)  Why did it get this far without you receiving any letters before claim and the N1 claim form from CCBC?  Did you fail to update your V5C when you moved?

    No, that is a stupid idea and as this will be four figures you will have bailiffs at yours in no time. CAB are not clued up enough on the parking industry.

    Did they seriously send FIVE SEPARATE claims to an old address without checking?

    Are the claims all about the same car, location and alleged breach, just different PCN dates?

    You must file them all this week, including in your draft Order saying that you need an urgent stay of execution/enforcement and a single hearing for all 5 to be set aside.  And that the Claimant be ordered by the court to pay back your 5 x fees for unreasonable conduct.

    Copy any other CCJ set aside thread, we have loads.  Someone was working on a Draft Order only yesterday. And a WS of course, proving they were not at the old address but were 'there to be found' for the sake of a 29 pence soft trace.

    Because CCBC are so crap with emails and admin, I'd recommend your applications go to your local court.  No hanging about and mark it 'urgent: stay of enforcement and CCJ set aside x 5 improperly served claims'.

    List all 5 claim numbers snd carefully double check them.

    I think it's time someone got Watchdog to expose what CEL are doing under supervision of their ex-Wonga Barrister head of the legal team.  Shocking approach.

    CEL are killing people's peace of mind and credit ratings and it looks like they never check addresses before suing, despite the BPA Code requiring it.

  • Hi yes all 5  'offences' were in the same car park as I worked there at the time. The court gave me the details when I rang them up. All over a 6 month period. I had inforned the DVLA of my change of address in 2014. But not updated my log book as I didn't know I had to. So they have been writing to my old address I lived at prior to 2014 for all these years. I have since moved again and updated my records and now DCBL have traced me. I had no clue that the ccjs existed and never thought to check my credit record. I am extremely stressed about it all and its taking me time to get to grips with the legal side. Do I definitely have a case as I'm going to have to pay 5 x £275 to get the ccjs set aside ?

    Yes you definitely have a case and must crack on with all the applications.  We do these literally all the time, with success, and most Judges would also order CEL to pay your costs back (as long as you ask).

    You are also likely to win the case against the PCNs because we win 99% of the time in hearings about defending PCNs. 

    Or you might even persuade the Judge to dismiss ALL five claims when he/she sets aside the CCJs, due to the claims being 'dead' (for want of service within 4 months of filing them).

    What they've done is appalling and in breach of their AOS Code of Practice.

    It is also completely unreasonable of CEL not to consolidate the alleged debts into one claim, because this is now causing you £275 x 5 in court fees instead of one.
