Crown wharf Walsall CP parking fine

Had a parking fine for Crown wharf Walsall we paid for parking but didn’t print a ticket checked bank and payment had been taken, so didn’t think anything of it. When had fine come through appealed and sent proof paid. They asked who was driving never had one of these before I said my husband and they’ve now sent it out to him. He’s appealed. On reading the threads I can see I made the mistake of saying who was driving. I’ve sent message to land owner and agent as mentioned in previous posts. But I can see people have had no response from these particular people. The parking charge was 2 months ago and my husband only received the letter to him yesterday so he only appealed again yesterday. This morning the parking is showing refunded in our account £1 the payment was taken 21st January. What do we do next. We obviously paid for parking but feel like they are playing dirty by refunding the £1 2 months later to try and claim we haven’t paid. My husband was only there 16mins and was collecting from Argos. We have the receipt from Argos and the proof payment was taken at that location on the date. I’m a real panickier and just want to get it sorted. Any help of the next step would be appreciated thank you.

    It is only a mistake to name the driver if the PCN was not POFA compliant and therefore no keeper liability.  Which parking company is involved?  Was the first notice sent to you as the registered keeper?  Presumably now your husband has a notice to driver in his name?  That is a sneaky trick refunding the payment!  Keep at the landowner - can Argos help?
  • Thank you for your reply. It’s C P plus. Yes that’s correct was first sent to me at the beginning February. Yes that’s right he has one now in his name. Yeah that’s what we thought. The payment was first taken 21st January and refunded today 18th March. I did wonder about contacting Argos. I’m guessing it’s worth a try then?

    Hammer every retail outlet you can and if that doesn't work, go to the managing agents (assuming there is one as it sounds like a shopping area).
  • Yes it’s a shopping area. He was only there 16minutes and paid the pound to park it’s so frustrating. I’ve messaged Argos and messaged the agent and owner. Honest shopper paying for parking and being fined for it. It really puts you off going. Especially as the parking company aren’t realising this. Is it worth doing the popla appeal?

    Yes, it's always worth doing a PoPLA appeal. Wait to see if you get a landowner cancellation first, but don't miss the appeal deadline.

    Use all the appeal points available from the third post of the NEWBIES, plus include proof that payment was made at the material time, plus frustration of contract because the PDT machine failed to supply a ticket.

    Post the draft appeal here for checking before it is submitted.

    Complain to the BPA that CP Plus' system refunded your parking £1 two months after the event and after you appealed, which you think was done to avoid admitting it was a system or keying error.  Nothing you did was your fault and if there was a keying error CP Plus have failed to admit it.

    Also complain to the managing agents who run Crown Wharf, as they have always cancelled unfair tickets.

    Seen it loads of times, and the guy's name who cancels them is in 'Successful Complaints'.  Posh guy, but fair, maybe JLL.  Search that thread if you can still search threads on this forum.

  • Thank you for all the replies. I’ve just complained to bpa as suggested. It doesn’t look like they are the agents any more which the link mentions. I have emailed both the agent and landowners which are listed. So will see if I get a response. How long do you have to appeal with popla? So that I don’t miss the deadline. The parking charge was for 21st Jan the original letter was 2nd feb and the new charge sent to my husband is dated 9th March. This is all new to me but just want to get the charge cancelled as its really worrying me.

    How long do you have to appeal with popla?
    If you have a POPLA code then it's (officially) 28 days from the date of the letter containing it, but we know that the code works for up to 32 (maybe even 33) days.
