Factor Fee’s!

I’m not sure if this is in the right place but I couldn’t find anywhere else to cover. We have been in our new build home for 1yr 6m (Scotland) and was one of the last to move in. The site has been finished for over a year. We have to pay factor fee (£75ish,pa) we paid an initial factor fee of (£185) on move day also. This is to cover ground work, green space, etc etc. however since we have moved in no further works have been complete. A green space in-front of our house is just a pile of mud and rubble, in the summer its overgrown wild grass at waist hight. 

What I want to know is am I obliged to pay if work is not being done?  Can I hold the money back until work is done? I have no issue paying but I won’t want to pay for another 12mth with no work being complete. 

Some advice or previous experience be great. Thank you all in advance.
